Privacy Policy – 10/05/22
This privacy policy explains how picky Gmbh, Rückertgasse 29/23, 1160 Vienna, Austria (further referred to as “picky”, “we”, “us” or “our”) handles, collects and uses your data.
1. Website – picky.vote
For our website https://picky.vote we do not collect any personal information and do not use tracking services such as Google Analytics.
Legal notice: you are entitled to receive information about saved data, correct data, delete data, restrict data, limit data transferring and decline data collection. For any of these topics please contact us directly (please find our contact information at the end of this document). If you find any of our data processing violates data protection law, or your rights have been breached in any other way, you can contact us directly or file a complaint at the Austrian “Datenschutzbehörde”.
2. Voting app “picky”
What data are we collecting?
When you setup your profile, we request your mobile phone number for authentication purposes. We do not use passwords, rather OTP’s (One Time Pin Codes) to securely log you in. The other option for registration is to use a third-party sign up/sign in service – “Sign in with Google” or “Sign in with Apple”, in which case you can use these third-party services to register/login to your account – in this case, some of your data will be handled by beforementioned third-party services in accordance with their own terms of service and privacy policy. To create your basic profile, picky asks for your birthyear, country, region (on a state level) and to create a nickname.
When entering the account page, users can set “optional data” that helps picky create meaningful statistics on the questions asked via the platform.
When voting, optional data gets transmitted to our servers via an anonymous code, so that picky is not able to trace back which user the optional data belongs to. We are also not using pseudonyms, we create unique codes each time you are voting, never building a profile of your voting activity. Picky is also not keeping track of how you voted, only storing the fact that you voted. How you voted is also only stored locally on your phone.
Picky is storing the surveys you create via the picky app, and storing which account created the survey, to be able to handle reports of unwanted content that is not in line with our terms of service.
Picky is collecting data via Google Analytics, but only in the context of basic app usage tracking, not for advertisement purposes, also not tracking your usage cross-platform nor for retargeting purposes.
How are we using your data?
Picky is only using user data to create survey statistics. Users are not able to see which users the data came from, and we ourselves are not able to trace back which part of the statistic came from which user – see explanation at “What data are we collecting”. Picky will never sell your data for advertisement purposes.
Our data retention and deletion process
We only store the necessary information as disclosed above. You are entitled to receive information about saved data, correction of data, deletion of data, restriction of data, limiting data transferring and declining data collection. 3. Kontiki City Guide
What data are we collecting?
Kontiki does not collect any user data. We prioritise your privacy and do not request any personal information during the setup process or registration. Our app does not use passwords; instead, we focus on ensuring a secure login experience through one-time PIN codes (OTPs). Additionally, users have the option to register or log in using third-party services such as “Sign in with Google” or “Sign in with Apple,” in which case data handling is governed by the terms of service and privacy policy of the respective third-party services.
How are we using your data?
Kontiki does not collect or use any user data as we do not gather personal information. Our app is designed to provide a seamless and private experience for users exploring the city guide content.
Data retention and deletion policy
Kontiki does not store any user data. We do not retain any personal information or statistics about user activity. As a result, there is no need for a data retention or deletion process. We are committed to ensuring that your privacy is protected while using our city guide app.

Terms of Service – 10/05/22
The following text contains the terms of service of picky GmbH, Rückertgasse 29/23, 1160 Vienna, Austria (further referred to as “picky”, “we”, “our” or “us”). Please read this document carefully before using/downloading our app or our other services.
The following applies to our picky voting app, further referred to as “our app” or “the app”.
1. License to Use
By downloading our app, we grant you a nonexclusive, worldwide, and perpetual license to perform, display, and use the product on your device in accordance with our terms and conditions.
2. Prohibited Conduct
Using our app, you will not:
Users under the age of 18 are prohibited from using the app. While picky has a reporting-system implemented to delete any illegal, spam, or otherwise harmful content, we cannot guarantee that content falling into beforementioned categories is always deleted immediately upon posting by users.
3. Termination
If you are violating any of the terms mentioned in this agreement, we reserve the right, in our sole discretion, to terminate your account and your right to access or use our app. We are not responsible for any damage, loss or harm related to your inability to access or use the app based on such termination.
It is also possible for you, the user, to terminate your account within the in-app account menu or by contacting us directly for any reason whatsoever. Please note, that the content (specifically questions/surveys and related content) you created while using the app is not automatically deleted upon account termination. If you wish to have this data deleted as well, please contact us directly at legal@picky.vote
4. User Generated Content
picky does not claim ownership of any content created or submitted by you in any area of the app. This applies to all surveys created and related actions. However, by posting/creating content you are granting us a royalty free, sub-licensable and worldwide license to copy, distribute, publicly display, edit, use your content for promotional purposes. Picky will never display your nickname or any of your other account information when sharing your content publicly or for promotional purposes.
This license is terminated as soon as either party deletes the content it adheres to. You can delete your content within the menu attached to each question or by contacting us at legal@picky.vote
5. Copyright infringement
picky respects the intellectual property rights of others and expects users to do the same. If you are a copyright owner, authorized to act on behalf of one or authorized to act under any exclusive right under copyright, please report alleged copyright infringement taking place on or through our app by contacting us at legal@picky.vote
Picky will expeditiously respond and investigate copyright infringement claims and act in its sole discretion to remove the challenged content from the app.
6. Modification of/Updating these terms
We, picky, reserve the right, at our sole discretion, to change or update these terms going forward at any time. Please periodically review the terms and conditions for any changes or updates that could materially modify your rights or obligations – in case of these substantial changes we will take an effort to notify you ahead of time, so you can react accordingly.
7. Disclaimer of Warranty
picky is providing the app and its services “as is” without warranty of availability or other expectations that user might hold towards the app. Users are using the app at their own risk and discretion. picky does not guarantee that the app is free from mistakes, errors or other issues that might be damaging to the user.
8. Disclaimer of Liability
You expressly agree to and understand that picky is not liable for any loss of data, inability to access the app for any reason whatsoever, copyright infringement of others, or any other direct, indirect, incidental, lost profits, special, consequential, punitive, or exemplary damages resulting from the use or inability to use our app or our services or resulting from data or information obtained from using our app or our service. This also includes damages arising from unauthorized access or alterations of the transmission of your data, for which picky is also not liable.
9. Governing Law
For these terms and conditions, the applicable law is Austrian Law. These terms will apply no matter where in the world you access our app or live.
